Introduction
By accessing GivingBack.tech.com and its related services, applications or tools (collectively referred to as ‘GivingBack.tech’) you are agreeing to the following Terms & Conditions which are designed to make sure that GivingBack.tech works for all concerned.
GivingBack.tech is provided and owned by Together For Cinema CIC of 57 Durleston Park Drive, Great Bookham, Surrey KT23 4AJ registered in England and Wales, number 14689594.
In these Terms & Conditions, ‘Donor’ or ‘Donors’ refers to any party posting items on the GivingBack.tech website.
In these terms & conditions, ‘Beneficiary’ or ‘the Beneficiaries’ refers to anyone viewing or making enquiries through the GivingBack.tech website about an item that has been listed for donation.
In these Terms & Conditions ‘Posting’ or ‘Post’ refers to an item listed by a Donor on the GivingBack.tech website.
These Terms & Conditions constitute a legally binding agreement between you and GivingBack.tech and are effective as of 1st January 2026. You accept these Terms and Conditions by clicking the ‘Register for GivingBack.tech’ button when registering for an GivingBack.tech Donor account or Beneficiary Account, and by otherwise accessing or using GivingBack.tech services, applications and tools, or as otherwise indicated on a specific site, service, application or tool.
GivingBack.tech - terms of use
By using GivingBack.tech Donors and Beneficiaries agree to be legally bound by these Terms & Conditions, which shall take effect immediately on your first use of GivingBack.tech. If you do not agree to be legally bound by all the following Terms & Conditions please do not access and/or use GivingBack.tech.
You agree to use GivingBack.tech only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use of GivingBack.tech. Prohibited behaviour includes harassing, causing distress or inconvenience to any person.
Advert format & placement
Our mission is to meet the goals of our Donors and Beneficiaries. However,
- GivingBack.tech does not guarantee the insertion, position or design of any particular Donor product;
- GivingBack.tech reserves the right to omit, suspend or remove any Donor listing Advertisement that is suspected of being fraudulent;
- GivingBack.tech reserves the right to make any alteration it considers necessary or desirable to an Donor listing;
- GivingBack.tech requires representative images for all Donor listings;
- Where images are not uploaded as part of an advertisement, GivingBack.tech reserves the right to restrict the placement of that listing on the GivingBack.tech website as it sees fit.
- The Donor shall be responsible for checking all aspects of a Listing once it appears on the GivingBack.tech website and making any changes necessary to ensure it meets GivingBack.tech Terms & Conditions.
- The Beneficiary agrees to indemnify GivingBack.tech in respect of all costs, damages or other charges falling upon GivingBack.tech as the result of legal actions or threatened legal actions arising from the publication of a listing added to the GivingBack.tech website by a Donor. In any case where a claim made against GivingBack.tech is used in litigation the Donor may ultimately be liable under the terms hereof. Notice in writing shall be given to the Donor and consultation shall take place before any expense is incurred or the claim is settled or the case is defended or otherwise disposed of.
Disclaimers and limitation of liability
GivingBack.tech takes no responsibility for any damage to equipment that results from any User viewing YouTube, Vimeo or any other movies hosted remotely and embedded onto the GivingBack.tech website.
GivingBack.tech content, including the information, names, images, pictures, logos and icons regarding or relating to GivingBack.tech and its services, is provided as is and on an is available basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
Under no circumstances will GivingBack.tech be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise):
- Loss of data;
- Loss of revenue or anticipated profits;
- Loss of business;
- Loss of opportunity;
- Loss of goodwill or injury to reputation;
- Losses suffered by third parties; or any indirect, consequential, special or exemplary damages arising from the use of GivingBack.tech regardless of the form of action.
GivingBack.tech does not warrant that functions of the GivingBack.tech services will be uninterrupted or error free, that defects will be corrected or that GivingBack.tech or the server that makes it available are free of viruses or bugs.
Nothing in these Terms & Conditions shall limit our liability for fraudulent misrepresentation, or for death or personal injury resulting from our negligence or the negligence of our agents or employees. You agree not to hold GivingBack.tech responsible for things another Donor or Beneficiary does.
We do not review users' postings and are not involved in the actual transactions between users. As the donor listings on GivingBack.tech come from other parties GivingBack.tech does not guarantee the accuracy of Adverts or User communications or the quality, safety or legality of what's offered.
In no event do we accept liability of any description for the posting of any unlawful, threatening, abusive, defamatory, obscene or indecent information, or material of any kind which violates or infringes upon the rights of any other person, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law.
Intellectual property
The names, images and logos identifying GivingBack.tech or its services are subject to copyright, design rights and trade marks of GivingBack.tech and/or third parties. Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any license or right to use any trademark, patent, design right or copyright of GivingBack.tech or any other third party.
Contributions to GivingBack.tech
Where a Donor submits a product listing to GivingBack.tech, it grants a perpetual, royalty-free, non-exclusive, sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, make available to the public, and exercise all copyright and in accordance with privacy restrictions set out in the GivingBack.tech website Privacy Policy. If you do not grant GivingBack.tech the rights set out above, please do not submit your product listing to GivingBack.tech.
By submitting a product listing to GivingBack.tech you warrant that your listing is:
Your own original work and that you have the right to make it available to GivingBack.tech for all the purposes specified above;
Not defamatory; and does not infringe any law; and will indemnify GivingBack.tech against all legal fees, damages and other expenses that may be incurred by GivingBack.tech as a result of your breach of the above warranty; and will waive any moral rights in your contribution for the purposes of its submission to, and publication on GivingBack.tech and the purposes specified above.
GivingBack.tech product listing rules
You may not submit any defamatory or illegal material of any nature to GivingBack.tech via a Listing or otherwise. This includes text, graphics, video, programs or audio.
Contributing material with the intention of committing or promoting an illegal act is strictly prohibited.
You agree to only submit images and text, which are your own original work. You must not violate, plagiarise or infringe the rights of third parties including copyright, trademark, trade secrets, privacy, publicity, personal or proprietary rights.
If you post or send offensive or inappropriate content anywhere on GivingBack.tech, or otherwise engage in any disruptive behaviour using the GivingBack.tech website, GivingBack.tech may use whatever information is available to it about you to stop any further such infringements. This may include informing relevant third parties such as your employer, educational activity or email provider about the infringement/s.
GivingBack.tech reserves the right to delete any Listing or take action against any Donor, at any time, for any reason.
Release
If you have a dispute with one or more GivingBack.tech Donors or Beneficiaries, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known or unknown, arising out of or in any way connected with such disputes.
Third party rights
A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this User Agreement but this does not affect any right or remedy of a third party specified in this Agreement or which exists or is available apart from that Act.
Personal information
By using GivingBack.tech, you agree to the collection, transfer, storage and use of your personal information by GivingBack.tech on servers located outside of the United Kingdom. You also agree to receive marketing communications from us unless you tell us that you prefer not receive such communications.
Resolution of disputes
If a dispute arises between you and GivingBack.tech, we strongly encourage you to first contact us directly to seek a resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.
General
If there is any conflict between these Terms & Conditions and specific terms appearing elsewhere on the GivingBack.tech website, then the latter shall prevail.
If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable. These terms shall be governed by and interpreted in accordance with the laws of England and Wales.
Changes to the site
GivingBack.tech reserves the right to make changes to the GivingBack.tech website, the disclaimers and these Terms & Conditions at any time without notice.
